MyaGuide Reception — Terms of Use

Document: Terms of Use · Product: MyaGuide Reception · Version 1.1 · International edition: 2 October 2026

1 Scope

1.1 These terms of use apply to the use of MyaGuide Reception (the "Service"), offered by Van Riemsdijk & Karman S.L., trading under the name MyaGuide, Jávea, Spain, NIF ESB21983580 ("MyaGuide", "we").

1.2 They apply to everyone who uses the Service, including Residents of a Location who view the Guide or ask a question to Mya, and other visitors ("you").

1.3 The Service is made available to you free of charge by the organisation that manages your Location (the "Responsible Organisation"). The arrangements between that organisation and MyaGuide are set out in a separate agreement. You do not become a party to that agreement and pay nothing for the Service.

1.4 These terms describe the safe use of a free information service. By opening the Guide, you do not enter into a commercial contract, you do not give consent for data processing, and you do not waive statutory rights. Mandatory law always prevails. Read these terms together with the Privacy Statement, the Cookie Statement, the AI & Data document, and the Accessibility Statement.

2 Definitions

Approved information: the information about a Location that the Responsible Organisation has approved and published via the Service.
Conversation: an exchange of messages between a Resident and Mya on an open page.
Mya: the automated text interface that selects answers from the Approved information.
Guide: the page with Approved information and access to Mya for a Location.
Location: a shelter or reception location registered in the Service by a Responsible Organisation.
Resident: someone staying at or present at a Location and using the Service. This is a functional term and says nothing about residence rights, nationality, or legal status.
Responsible Organisation: the organisation that manages a Location, or an operator designated by it.

3 The Service

3.1 With the Service, you can view the Approved information of your Location and ask questions about it in the available languages, without an account.

3.2 Use of the Service does not require registration and does not create a stored profile about you. See the Privacy Statement.

3.3 Mya helps with the information your organisation has published for this location. You can type or speak. OpenAI processes your question and the location information needed to make an answer; for Talk, OpenAI also processes audio. There is no video avatar. For general public information outside the location, Mya can search the internet using a short search query instead of your full conversation. Do not share names, identification numbers, medical details or other personal or confidential information; automatic checks do not recognise everything. Mya shows source links for external information. A listed opening time does not guarantee that a service is available now. Information can be incorrect or outdated. For personal or professional help, Mya refers you to staff; for urgent help, approach a staff member on site immediately. A Guide link can be forwarded and is not access security.

3.4 If your language is not available, you can make a language request. The Responsible Organisation and MyaGuide use those requests to determine which languages are added. A request does not give a right to a language or a delivery date.

3.5 MyaGuide may modify the Service. A material reduction in functionality will be reported to the Responsible Organisation in advance. Temporary free deployment during an emergency situation (MyaGuide for Good) never makes Mya an emergency service and does not reduce the protection of your data.

4 Your responsibilities and permitted use

4.1 Use the Service only to find information about your Location and not for unlawful purposes.

4.2 It is not permitted to: bypass or disrupt the security or abuse prevention of the Service; use the Service to harass, threaten, or mislead others; uncover the configuration or information of another Location; collect content using automated means; seek access to the Management Environment or to data not intended for you; distribute harmful code or test the Service for vulnerabilities without permission; or impersonate someone else.

4.3 You decide for yourself what you type to Mya. The AI & Data document explains which information you should better not enter.

4.4 MyaGuide may restrict access to the Service in whole or in part when reasonably necessary to prevent harm to the Service, other users, or third parties, or to comply with the law.

5 No advice, no emergency service

5.1 Mya does not provide medical, legal, financial, or immigration and asylum law advice. General information about such topics does not replace advice from an expert or staff member.

5.2 Mya is not an emergency facility. In an emergency, call 112 or directly seek out a staff member at your Location.

5.3 For information that is important for your safety, health, or rights, or if you do not trust the answer, check it with a staff member.

6 Intellectual property

6.1 The rights to the Service, the software, the technology, and the documentation remain with the rights holders and licensors. MyaGuide operates the Service under license. You are granted only the right to use the Service for its intended purpose.

6.2 The Approved information remains the property of, or licensed to, the Responsible Organisation. The name MyaGuide and the associated logos remain with their rights holders.

7 Liability

7.1 The Service is a free information channel. MyaGuide makes efforts to keep the Service available and secure, but does not guarantee that the Service will operate uninterrupted or error-free. The Responsible Organisation is responsible for the accuracy and timeliness of the Approved information.

7.2 To the extent permitted by law, MyaGuide is not liable for indirect damage or for decisions you make based on general information from the Service. Mya is not a medical, legal, immigration, or emergency service and must not be used for decisions with legal, medical, residence-rights, or safety consequences; article 5 describes how to obtain appropriate help.

7.3 Nothing in these terms excludes liability that cannot be excluded by law, including liability for intent, deliberate recklessness, or injury caused by negligence. Your statutory rights as a consumer remain fully in force.

8 Data protection, cookies, and accessibility

The processing of personal data is set out in the Privacy Statement, the use of cookies in the Cookie Statement, and the accessibility of the Service in the Accessibility Statement. These documents form part of these terms.

9 Governing law and competent court

9.1 These terms are governed by Spanish law. Mandatory consumer protection of the country where you live remains applicable when it is more favorable to you.

9.2 Disputes will be submitted to the competent court in Spain, unless mandatory law gives you the right to choose another court.

10 Miscellaneous provisions

10.1 The English text of these terms is binding. Translations, including automatically generated translations in the Service, are intended as an aid; in the event of a discrepancy, the English text prevails.

10.2 If a provision is invalid, the remaining provisions remain in force.

10.3 Failure to enforce a provision does not mean waiver of any right.

10.4 We may amend these terms. In the event of a substantive change, a new effective date will be stated and, at the start of a new session, we will display a notice in the Service. No identification of you is entered to track acceptance.

11 Minors and supervised use

These terms describe rules of use for a free information service and do not require legal capacity to enter into an agreement. A minor Resident may use the Service on that basis. Supervision of the use of digital services by minors at a Location is the responsibility of the Responsible Organisation.
